Assumption of Risks:
Physical conditioning and training, by its very nature, carries with it certain inherent risks that cannot be eliminated regardless of the care taken to avoid injuries. Fuse Fitness Studio, its exercise physiologists, its personal trainers, nutrition consultants and other employees provide an opportunity for clients to improve their strength, nutrition, and cardiovascular fitness in a personalized program that is designed specifically for each individual by a trained exercise physiologist and individually monitored by a trained personal trainer. Regardless of the care taken however, accidents and injuries can occur through no fault of the client and no fault of Fuse Fitness Studio, its staff, or agents. Strength-building activities include exercises on apparatus to develop leg strength, arm strength, abdominal strength and strength of muscle groups. Strength-building activities place additional demands upon the body since they involve strenuous maximal, or near-maximal, exertions of force using various muscle groups. Cardiovascular activities also place additional demands upon the body since they generally involve prolonged moderate to vigorous exercise on exercise bikes, treadmills, steppers, and other forms of cardiovascular equipment.
These activities will involve sustained physical activity that places stress on the cardiovascular system. The nutrition program consists of goal setting, body measurements, an eating plan, food diaries, and behavior modification strategies. The inherent risks of strength-building and cardiovascular activities vary with the activity and muscle group involved. Common minor risks include minor muscle strains, muscular fatigue, and post-exercise soreness. More serious, but infrequent, risks include joint sprains, torn muscles, and back injuries. There is also the very remote risk of a catastrophic incident (e.g., heart attack, stroke, paralysis, or death). I have read the previous paragraphs and I know the nature of the activities at Fuse Fitness Studio, I understand the demands of those activities relative to my physical condition and skill level, and I appreciate the types of injuries that may occur as a result of activities made possible at Fuse Fitness Studio. I hereby assert that my participation is voluntary and that I knowingly assume all such risks.
Waiver of Liability:
In consideration of permission to use the property, facilities, and services of Fuse Fitness Studio, today and on all future dates for the duration of the Client Agreement, I (on behalf of myself, my heirs, personal representatives, or assigns) do hereby release, waive, covenant not to sue, and discharge Fuse Fitness Studio, its owner, directors, officers, employees, volunteers, independent contractors, and agents from liability from any and all claims including those arising from the ordinary negligence of Fuse Fitness Studio, its employees, or agents. This agreement applies to 1) personal injury (including death) from incidents or illnesses arising from participation in Fuse Fitness Studio activities (including, but not limited to, organized training activities, fitness tests, observation, the nutritional program, individual use of facilities or equipment, shower/locker room area, and all premises including the associated sidewalks and parking lots); and to 2) any and all claims resulting from the damage to, loss of, or theft of property.
Indemnification and Hold Harmless:
I also agree to hold harmless and indemnify Fuse Fitness Studio from any and all claims (including the ordinary negligence of Fuse Fitness Studio, its employees, or agents) arising from my participation in the nutrition and exercise program at Fuse Fitness Studio and to reimburse Fuse Fitness Studio for any expenses incurred as a result of my involvement at Fuse Fitness Studio. I further agree to pay all costs and attorneys’ fees incurred by Fuse Fitness Studio in investigating and defending a claim brought by me or on my behalf by my heirs, personal representatives, or assigns.
Severability and Venue:
I further expressly agree that the foregoing Assumptions of Risks, Waiver of Liability, and Indemnification Agreement is intended to be as broad and inclusive as is permitted by the law of the Province of Alberta and that if any portion thereof is held invalid, it is agreed that the balance shall, notwithstanding, continue in full legal force and effect. Likewise, I agree that if legal action is brought, it must be brought in the appropriate court in Calgary, Alberta.
Acknowledgements, Assertions, and Agreements:
